1. Preamble

These General Conditions of Sale (the “Conditions”) are concluded between 1000 GANTS and any non-commercial individual (“You”) wishing to make a purchase (excluding products sold through the Marketplace) on 1000gants.com. They exclusively regulate your relationship with 1000 GANTS.

1000 GANTS has the right to modify the General Conditions at any time. They will then be applicable from their on-line publishing.

2. Products

The products regulated by these Conditions are those appearing on 1000gants.com and listed as sold, and shipped by 1000 GANTS (the “Products”). They are sold and sent within the limit of available stock.

Indications of item availability are provided on the Product sheet and/or when placing the order.

If any of the items or materials are unavailable in our stocks, we undertake to contact and inform You by email within a maximum period of 15 days from the date of your order, and to tell You how soon the order could be delivered to You. You will then have the option of maintaining your order or cancelling it. The cancellation will lead to a full refund according to the conditions mentioned in Article 7.

The main characteristics of the Products are described and presented as accurately as possible. We draw your attention to the fact that the colours displayed may vary, depending on the quality and setting of your computer screen (colourimetry). This is why, in some cases, You may notice slight differences between the colours of the Product received and those You will have viewed on your screen. Some Products are 100% handmade and, as such, may have irregularities related to artisanal manufacturing and “natural” raw materials.

3. Prices

Products prices are quoted in Euros, all taxes included, and take into account the VAT (20% on January 1, 2014), including any discounts applicable on the day of the order.

Products prices are exclusive of delivery costs (shipping and packaging according to rates in force). Shipping costs are indicated before the order is confirmed.

If one or more taxes or levies – in particular environmental taxes – were to be created or modified – upwards or downwards – this change may affect selling prices of Products listed on www.1000gants.fr and on sale materials.

Prices are subject to change at any time, it being understood that the items are invoiced on the basis in force when the order is registered. Any change in the applicable legal VAT rate will be automatically reflected in the prices of the items, as soon as it comes into force.

4. Orders

4.1 Prior Identification

To place an order, you need to identify yourself with your email address or customer number, and with your password. For any first order, creating a customer account is requested.

4.2 Order Registration and Validation

Once your basket has been validated, You will have to enter the delivery address, choose the shipping method, and validate your payment method. This last step formalises the sales contract with 1000 GANTS.

Any order implies acceptance of the prices and descriptions of the Products available for sale.

Upon validation, 1000 GANTS will acknowledge receipt of your order and will send You an email.

In certain cases – in particular in cases of non-payment, incorrect address or any other problem related to your account, 1000 GANTS reserves the right to block your order until the problem is fixed.

In the event that a product ordered is not available, You will be informed by email. Cancellation of the order for this Product and its possible refund (only Products available at the time of the order can be subject to a direct debit, as opposed to deferred Products), will then be carried out, the rest of the order remaining firm and definitive.

5. Payment Terms

Your account will be charged before Products are dispatched. In the event of Products being sold out or unavailable, the amount of these Products will be refunded.

In the event of credit/debit card payment, financial information (credit/debit card number or expiry date for example) will be transferred by SSL encrypted protocol to our partner MERCANET without third parties having in any case access to it. Such information will never be used by 1000 GANTS, except to complete the procedures related to your purchase, or to issue refunds in the event of any Product return according to the right of withdrawal, or should it be necessary to report to competent authorities occurrence of fraud on www.1000gants.com site.

Payment card numbers are not kept in our information systems.

If your debit/credit card is not in euros, the final price is calculated in accordance with the exchange rate applicable on the day your card issuer processes the transaction.

We remain owners of the items sold until full payment, VAT and shipping costs included.

6. Delivery

For France, two shipping modes handled by France post office La Poste are possible:

– Tracked Letter or simple mail (cost: €0)

– Colissimo service with acknowledgement of receipt (cost: €5)

International shipping is carried out with France post office La Poste by Colissimo (cost: €10).

Delivery times are not guaranteed by La Poste.

1000 GANTS does not deliver to PO boxes.

1000 GANTS cannot be held responsible where the indicated delivery address is incorrect or incomplete.

7. Right of Withdrawal and Exchange

7.1 Right of Withdrawal and Return Policy

You have a right of withdrawal, within fourteen (14) calendar days of receipt, to return the product at your expense, without penalty and without justification, under the conditions laid down in Article L. 121-20 and following of French Consumer Code.

Returned products should be returned unused, intact, and complete. They must not have been worn, used, modified or damaged, and be in perfect condition.

To exercise your right of withdrawal, we invite you to return the products concerned, at the latest within fourteen (14) days of receipt of the package by La Poste, accompanied with a letter stating your intention, in appropriate packaging, at your expense, with adequate postage, to the following address:

Upon receipt of the product, 1000 GANTS will acknowledge receipt of your withdrawal by email.

The return costs from the place of delivery to our store are your responsibility – with the exception of a defective product at reception, or an error of 1000 GANTS when sending the product.

7.2 Refund

As part of your right of withdrawal, 1000 GANTS undertakes to refund you for all sums paid, upon receipt of your package, or upon receipt of proof of return of your package that you will have returned to us at the following address:

1000 GANTS will refund you for the returned products, subject to compliance with conditions mentioned above, as well as the standard “one-way” return shipping costs.

The refund will be made by the payment method selected by you for your initial order. Thus, if the order has been paid:

• By credit card –and if this credit card is still valid– the refund will be processed to the account attached to this credit card.
• By check, the refund will be made by check, to be sent to the billing address.
• By bank transfer, the refund will also be made by bank transfer subject to having provided us with the IBAN code of your account.

8. Guarantees

1000 GANTS items are covered by the legal guarantee of conformity as well as the guarantee against hidden defects, in accordance with the provisions in force (Articles L. 211-1 to L. 212-1 of the French Consumer Code, Articles 1641 and 1648 of the French Civil Code).

You have a period of two (2) years to invoke those guarantees with the Customer Service. This period runs from the Product delivery with regard to the legal obligation of conformity (Article L. 211-12 of the French Consumer Code) and from the discovery of the defect with regard to the guarantee of hidden defects (Article 1648 of the French Civil Code).

9. Proof of Purchase

In all cases, the online provision of the credit card number and the final order validation will constitute proof of the completeness of said order, in accordance with Article 1316-1 of the French Civil Code, and will be worth payment of the sums involved for the Products listed on the order form.

This validation is equivalent to signature and express acceptance of all operations carried out on 1000gants.com. However, in the event of fraudulent use of your credit card, You are requested to contact us by email at contact@1000gants.com, as soon as You discover this fraudulent use.

The computerised registers, kept in the information systems of 1000 GANTS and its partners under reasonable security conditions, will be considered as proof of communications, orders, and payments made between You and 1000 GANTS.

The filing of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with Article 1348 of the French Civil Code.

10. Responsibilities

1000 GANTS undertakes to describe the Products sold on 1000gants.com as accurately as possible.

However, the responsibility of 1000 GANTS cannot be engaged in case the non-performance of its obligations is attributable either to the unpredictable and insurmountable fact from a third party of the contract, or to a case of force majeure as defined by French jurisprudence.

Similarly, the responsibility of 1000 GANTS cannot be engaged for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

13. Applicable Law

Terms and Conditions are subject to French law. The court of jurisdiction in case of dispute will be that of the place of residence of the defendant or – as the applicant chooses – that of the destination to which Products were delivered.
